Selling your apartment in Marbella: price, paperwork and smart tips

Imagine Marbella Editorial Team ·

Short answer: you sell an apartment in Marbella quickly with three things: a price in line with recent sales in your complex, a complete file (including the community of owners certificate) and a strong online presentation. Apartment buyers pay extra attention to community fees, parking and location. We calculate your net proceeds in advance.

You sell an apartment or penthouse in Marbella differently from a villa. The buyer often chooses convenience: a second home where you just lock the door, a communal pool, a walk to the beach or the centre. If you understand that, you present your apartment that way too. In this guide you'll read what apartment buyers want to see, how to set the price and which documents to have ready. In plain language, including the pitfalls.

What's different about an apartment?

With a villa you buy a house and a plot. With an apartment you buy a home within a community (comunidad de propietarios). That changes what buyers find important:

  • The monthly community fees. Buyers compare that amount with other apartments.
  • The condition of the building and communal areas: lift, pool, garden, façade, roof.
  • Planned works and special levies (derramas). A buyer wants to know if a big expense is coming.
  • Parking space and storage room. Is it included in the price, and is it in the deed?
  • Community rules, for example on pets, works or letting.

Having those answers ready in the listing and the file builds trust and saves time.

Step 1: set the right price

A good price is the best marketing. For an apartment we look at:

  • recent sale prices in the same complex and area, not just asking prices;
  • the floor, views and orientation (sea, golf, mountains, garden);
  • the terrace or garden: how big, how sunny, how private;
  • the condition and finish, and whether it has been renovated recently;
  • the community fees and what they cover;
  • current demand for this type of apartment.

The Marbella property market remains strong: the average asking price in September 2026 was around 5,970 euros per m², over 3 percent higher than a year earlier. An average says little about your apartment, as differences between areas are large. Find more figures in our article on the property market in 2026. Want a well-founded price? Step 2: get your paperwork in order

Buyers and their lawyers check everything. Have these seven documents ready:

  1. The title deed (escritura) and a recent nota simple from the Land Registry.
  2. The energy certificate, required before you can advertise.
  3. The community certificate confirming you have no debts, and the latest minutes (actas) of the general meeting.
  4. The community bylaws and the amount of the monthly fee.
  5. Proof of IBI payment (property tax).
  6. The occupancy certificate (licencia de primera ocupación) or an equivalent document.
  7. Building plans and permits if you've changed anything, for example an enclosed terrace.

Missing a document? Request it early. Some community certificates take a few working days.

Step 3: presentation that sells

Many buyers decide online. An apartment sells best with:

  • professional photos in good light, including the terrace and the view;
  • a floor plan with dimensions;
  • a description in several languages, because buyers come from all over Europe;
  • a tidy, neutral home with small repairs done and a fresh coat of paint.

We take care of the presentation, in English, Dutch, French and Spanish.

Holiday letting: an extra selling point, but beware

Many apartment buyers are thinking of letting. Rules apply: holiday letting requires a licence and the community can impose restrictions. An apartment with a valid licence is extra valuable to an investor. If you don't have one, you may not market it as if you do. Since April 2025, three fifths of the owners in a building must agree before a new holiday let can start. Read all the rules in renting out your property in Spain. Which costs and taxes do you pay?

As the seller you pay the agent's commission, the municipal plusvalía, the energy certificate and possibly the cancellation of your mortgage. If you don't live in Spain, the buyer withholds 3% and you pay 19% tax on your gain. You'll find everything in three separate articles:

Selling smart: three tips for apartments

  • Request the community certificate straight away. It's often the document that delays the sale.
  • Be honest about planned works. Buyers will find out through their lawyer anyway. Being honest prevents last-minute price negotiations.
  • Make the most of the terrace. Photos of a terrace with a view often sell an apartment faster than a photo of the living room.

Frequently asked questions

How long does it take to sell an apartment in Marbella?

It depends on price, location and presentation. A well-priced, fully prepared apartment sells much faster than an overpriced one. You get a personal estimate with the valuation.

Which documents do I need to sell my apartment?

The title deed, the nota simple, the energy certificate, the community certificate, the latest minutes, proof of IBI and the occupancy certificate.

Who pays the community fees during the sale?

They're usually split pro rata to the period of ownership and set out in the deed. The community certificate shows whether there are any debts.

Do I have to pay the plusvalía when selling an apartment?

Yes, the seller pays the municipal plusvalía, unless there is no increase in land value.

Can I sell my apartment if I live abroad?

Yes. With a power of attorney signed before a notary, someone can sign the deed for you. We arrange this together with your lawyer.

What is a derrama?

A derrama is a special levy the community charges for a major expense, such as a new façade or lift. Buyers want to know in advance whether one is planned.
